These Terms of Service govern your use of littlechickart.com and your purchase of products or services from Little Chick Art.
Throughout these Terms, “Little Chick Art,” “we,” “us,” and “our” refer to Little Chick Art. “You” and “customer” refer to the person visiting the website, placing an order, or requesting a service.
By visiting the website, submitting information, uploading files, placing an order, or purchasing a product or service, you agree to these Terms of Service and the policies linked on the website.
1. Eligibility
You must be at least the age of majority in your state, province, or country of residence to place an order.
A parent or legal guardian must place and manage any order involving a minor.
You may not use the website or its products and services for unlawful, fraudulent, abusive, or unauthorized purposes.
2. Products and Services
Little Chick Art currently offers products and services that may include:
- Personalized canvas wall art
- Custom digital artwork
- AI video production
- Other creative products or services added to the website
Products, services, features, prices, and availability may change without notice.
We reserve the right to limit quantities, decline a project, cancel an order, discontinue a product, or refuse service when reasonably necessary.
If a paid order is declined before work or production begins, the amount paid for the declined item will be refunded.
3. Personalized Canvas Wall Art
Personalized canvas wall art is created using the photograph, canvas size, orientation, and artwork style selected by the customer.
The customer is responsible for reviewing all selections before completing the order.
Final printed results may vary slightly from what appears on a screen because of:
- Monitor and device settings
- Printing materials and processes
- Cropping or resizing needed for the selected canvas
- Differences in brightness, contrast, texture, and color
- The quality and dimensions of the original photograph
These normal production differences are not considered defects.
Canvas products are fulfilled through third-party printing and shipping providers.
4. Custom Digital Artwork
Custom digital artwork is individually prepared from the customer’s uploaded photograph and selected artwork style.
The finished file is delivered electronically. No physical product is included unless a physical item is separately purchased.
Customers are responsible for downloading and safely storing completed files. Little Chick Art may assist with redelivery when a file remains available, but permanent storage or unlimited future redelivery is not guaranteed.
Unless otherwise agreed in writing, custom digital artwork is provided for personal use, including personal display, sharing, and printing.
Commercial reproduction, resale, sublicensing, merchandise production, or use as a business logo or trademark requires written permission or a separate commercial agreement.
5. AI Video Production
AI video projects are created according to the package, format, concept, scope, and other details agreed upon for the project.
Quoted or advertised package lengths are approximate final-video lengths and may vary slightly when reasonably necessary for pacing or editing.
Each standard package includes one video format unless otherwise stated. Additional formats, alternate versions, rush production, major changes, and extra revisions may require additional fees.
Project timelines are estimates and may be affected by:
- Project complexity
- Customer response time
- Revision requests
- Rendering or technical problems
- Third-party platform availability
- Changes to the original project scope
AI-assisted creative tools can produce unexpected variations. Little Chick Art will make reasonable efforts to create a polished result consistent with the approved concept, but an exact recreation of a reference, person, performance, style, motion, or imagined result cannot be guaranteed.
Little Chick Art does not guarantee that a video will achieve a particular number of views, sales, followers, leads, engagement, advertising results, or other business outcome.
6. Customer-Submitted Materials
You may submit photographs, names, logos, instructions, recordings, reference materials, and other content for use in your order or project.
By submitting materials, you confirm that:
- You own the materials or have permission to use them
- You have permission from identifiable individuals when required
- The materials do not violate another person’s copyright, trademark, privacy, publicity, or other rights
- The materials are not unlawful, threatening, defamatory, exploitative, or otherwise prohibited
- Little Chick Art may use the materials as reasonably necessary to review, create, produce, fulfill, revise, and support your order
Print providers may reject content that violates intellectual-property rules or prohibited-content policies.
You remain responsible for the legality and accuracy of the materials you submit.
Little Chick Art may decline or cancel an order involving materials that appear unauthorized, unlawful, harmful, or unsuitable for production.
7. License to Complete Your Order
You retain your rights in the original materials you submit.
You grant Little Chick Art and its necessary service providers a limited, nonexclusive license to copy, modify, process, transmit, store, print, and otherwise use those materials solely as reasonably needed to:
- Review your order
- Create the requested artwork or video
- Produce and deliver the finished product
- Make approved revisions
- Provide customer support
- Maintain necessary business records
Private customer photographs will not intentionally be used in public advertising or portfolio displays without permission.
8. Creative Ownership and Working Files
After full payment, you may use the final delivered product according to the usage rights stated in these Terms or in your written project agreement.
Unless otherwise agreed in writing, Little Chick Art retains ownership of:
- Prompts
- Templates
- Editing methods
- Production techniques
- Internal project files
- Layered or editable source files
- Unused concepts
- Drafts and rejected versions
- General creative systems and workflows
The purchase of a finished product does not automatically include editable files, project files, prompts, source materials, or ownership of Little Chick Art’s underlying methods.
9. Third-Party Materials and Services
Products and projects may involve third-party services such as:
- Shopify
- Payment processors
- Print providers
- Shipping carriers
- Customer-upload applications
- Digital-delivery applications
- AI-generation platforms
- Fonts, music, stock media, software, or other licensed resources
Third-party services may be governed by separate terms, licenses, availability, and technical limitations.
Where a final project contains licensed third-party material, your use of that material remains subject to the applicable license. You may not extract, resell, redistribute, or claim exclusive ownership of a third-party element by itself.
10. Orders and Acceptance
Submitting an order does not guarantee acceptance.
An order may be reviewed before work or production begins. We may contact you if:
- The uploaded photograph is unsuitable
- Information is missing
- The selected size may not work with the image
- Instructions are unclear
- The request exceeds the purchased service
- The submitted content presents a legal, safety, or production concern
Failure to respond may delay or prevent fulfillment.
We reserve the right to cancel an order that cannot reasonably be completed. Any refund eligibility will be determined under the Return and Refund Policy.
11. Prices and Payment
Prices are displayed in United States dollars unless otherwise stated.
Payment is due at checkout for website purchases.
AI video projects or other custom services may require a deposit, milestone payment, or full payment according to the written quote, invoice, or project agreement.
Final unwatermarked video files may be withheld until the required payment has been completed.
You agree to provide accurate billing, contact, and payment information.
Taxes, shipping charges, customs duties, and other applicable charges may be added when required.
12. Revisions and Changes
Included revisions, when applicable, are limited to reasonable changes within the originally approved concept and project scope.
The following may be treated as new or additional work:
- Replacing the source photograph after work has begun
- Requesting a different artwork style
- Changing the video concept, message, characters, or direction
- Adding scenes, products, formats, or deliverables
- Rebuilding approved work
- Requests made after final approval
- Changes outside the purchased package
Additional work may require a new quote or fee.
13. Customer Review and Approval
You are responsible for reviewing proofs, previews, spelling, names, dates, details, instructions, and other customer-provided information.
Approval authorizes Little Chick Art to proceed with final delivery or physical production.
Little Chick Art is not responsible for customer-approved errors or for errors contained in information supplied by the customer.
14. Turnaround and Delivery
Turnaround, production, shipping, and delivery dates are estimates unless a written agreement expressly states otherwise.
Little Chick Art is not responsible for delays caused by circumstances outside reasonable control, including:
- Carrier delays
- Print-provider delays
- Weather
- Equipment or software failures
- Internet or platform outages
- Payment holds
- Supply problems
- Customer response delays
- Events of force majeure
Digital files are considered delivered when they are sent to the customer’s provided email address or made available through the designated download method.
15. Cancellations, Returns, and Refunds
Cancellations, returns, replacements, and refunds are governed by the Return and Refund Policy.
Because personalized products and custom creative services are made specifically for each customer, cancellation or refund availability may end once editing, generation, production, or other custom work begins.
16. Shipping
Shipping terms for physical products are governed by the Shipping Policy.
Customers are responsible for entering a complete and accurate delivery address.
Digital artwork and AI video services are delivered electronically and do not require physical shipping.
17. Prohibited Uses
You may not use the website, products, or services to:
- Violate any law or regulation
- Infringe intellectual-property or privacy rights
- Submit content you do not have permission to use
- Harass, threaten, exploit, or defame another person
- Distribute malware or harmful code
- Attempt unauthorized access to the website or another account
- Scrape, copy, or misuse website content
- Resell or falsely represent Little Chick Art’s work as your own service
- Use completed work in an unlawful, deceptive, or harmful manner
- Interfere with website operation or security
We may suspend access, refuse service, or cancel an order when these Terms are violated.
18. Website Information
We make reasonable efforts to keep product descriptions, prices, policies, and other website information accurate.
Occasional errors, omissions, outdated information, or technical problems may occur.
We reserve the right to correct errors, update information, or cancel an affected order. If a pricing or listing error affects a completed purchase, you will be contacted and offered an appropriate resolution.
19. Disclaimer of Warranties
To the fullest extent permitted by law, the website, products, and services are provided on an “as available” basis.
We do not guarantee that:
- The website will always be uninterrupted or error-free
- Every uploaded photograph will be suitable
- Creative results will exactly match a customer’s imagination
- Colors will display identically across screens and printed materials
- Third-party platforms or delivery services will always remain available
- Creative or promotional work will produce a particular business result
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
20. Limitation of Liability
To the fullest extent permitted by law, Little Chick Art will not be liable for indirect, incidental, special, punitive, or consequential damages, including lost profits, lost business opportunities, lost data, or loss arising from third-party services.
To the fullest extent permitted by law, Little Chick Art’s total liability relating to a particular order or project will not exceed the amount the customer paid directly to Little Chick Art for that order or project.
These limitations do not apply where prohibited by law.
21. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold Little Chick Art harmless from claims, losses, liabilities, damages, and reasonable expenses arising from:
- Materials you submitted
- Your violation of these Terms
- Your infringement of another person’s rights
- Your unlawful or unauthorized use of a completed product
22. Privacy
Personal information is handled according to the Privacy Policy.
By using the website, you acknowledge that information may be processed by Shopify and other service providers needed to operate the store and fulfill orders.
23. Governing Law
These Terms are governed by the laws applicable in the State of Illinois, United States, without regard to conflict-of-law principles.
Nothing in this section removes consumer rights that apply under the laws of the customer’s location when those rights cannot legally be waived.
24. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect.
25. No Waiver
Failure to enforce a provision of these Terms does not waive the right to enforce it later.
26. Entire Agreement
These Terms, together with the Privacy Policy, Return and Refund Policy, Shipping Policy, product descriptions, invoices, quotes, and written project agreements, form the agreement between you and Little Chick Art regarding the applicable purchase or service.
A specific written project agreement controls if it directly conflicts with these general Terms for that project.
27. Changes to These Terms
These Terms may be updated to reflect changes in products, services, technology, business practices, or legal requirements.
The current version will be posted on this page with a revised “Last updated” date.
Changes apply prospectively unless otherwise required by law.
